The embassy would then witness me signing the same, authorize it or somehow notarize it, and I would be on my way. A little more complicated than that but it worked, finally. Just not easily. And it helped that by then we had moved to Mexico City, where the INM building is huge and theyâve seen everything.
My original application was submitted in San Miguelâwhere we lived at the timeâand things are never easy in smaller towns and smaller offices. In the cities, theyâve seen and dealt with it all before, so thereâs precedence. Plus, San Miguelâs INM office is incredibly busy all the time. In retrospect, Iâd have given the whole file over to Sonia from the beginning if I was doing this over.
Do consider having the husband be the one who applies from inside Mexico if you are going this route and youâve changed your last name. His name will always be the same.
But itâs not even just the last name that can get you in trouble. For example, suppose you didnât take your husbandâs name. But your passport says âMary Elizabeth Smithâ and your marriage certificate says âMary E Smithâ. Your application will be rejected.
If applying from within the country on a family-sponsored visa, it is helpful to have the services of a facilitator, as it can be quite complicated.
Ayudita: If the wife qualifies and the husband enters on a tourist visa as the family member looking to obtain residency from inside the country, this can often be easier. The husbandâs name on his passport more often matches the name on the marriage license.
Other family visas
Visa through marriage to a Mexican National
This method means no pre-approval at a Mexican consulate outside the country and no financials are required. Probably the easiest visa of all. The process can be started in Mexico. The expat spouse must have a valid tourist visa.
Itâs simpler if the marriage takes place in Mexico, otherwise the marriage license must have an apostille attached or be legalized, and both the license and the apostille must be translated by a certified translator in Mexico. Make it easy on yourself and get married in Mexico!
Visa through children
There is a family visa which allows foreigners with a child born in Mexico to become permanent residents (not temporary residents) by applying in Mexico, with no need to prove financials.
Parents need a current tourist visa, the childâs Mexican birth certificate and government-issued ID. The names in the parentsâ passports must be exactly the same name as parentsâ names on the childâs birth certificate.
Expired visas
Perhaps one advantage to a permanent residency is that it never expiresâunless you land on the wrong side of the law, in which case you can expect to have whichever visa ripped from your hot little hands. Temporary resident visa expiry dates are written day/month/year. And thus, 11/02/2020 is 11 February 2020ânot November 2, 2020. If you waited until November to renew, you would be out of luck.
